"This article":http://law.vanuatu.usp.ac.fj/jspl/current/hughes explores some key themes of the gene patent debate. Rather than being a specific problem domain, gene patents simply bring into sharp focus the inability of the patent system to afford the proper level of protection to incremental innovations. By extending the strong protections of the patent system to sub-patentable innovations, some researchers are receiving gains disproportionate to their efforts, and the tragedy of the anti-commons looms.
