Open Source software is largely a creature of copyright. It has often been claimed by some (like Bruce Perens) that patents provide the biggest challenge to open source. Newsforge is running an "article":http://www.newsforge.com/article.pl?sid=04/07/22/201217 by Lawrence Rosen which provides a more positive viewpoint.

I must confess I haven't read it yet. I'll have to post some reactions once I have.
